DOES THE MONEY RAISED BY THE WEST MEMPHIS THREE DEFENSE FUND ACTUALLY BENEFIT ALL THREE MEN?

According to Dan Stidham, who represented Jessie Misskelley pro bono for nearly fifteen years, the answer to the question of equal funds distribution is no. In fact, in the past three years virtually none of the donated funds collected by The West Memphis Three Defense Fund has made its way to the defense teams for Jessie Misskelley or Jason Baldwin, the other two members of the WM3. Stidham was told at one juncture when he sought funds for testing: “right now Damien Echols is our priority.” 

Add to this the fact that Jason Baldwin went for years without any legal assistance at all - to the point that he had to file his petition for post-conviction relief pro se (by himself) and it becomes clear that an inequity in the fundraising has existed for some time. 

Stidham calls this lack of openess and fairness in fund distribution "an injustice inside an injustice."

Each young man in this case has dramatically different legal hurdles to overcome.  Each will walk out of prison through a different door.  But each desperately needs monetary and emotional support because "no one life is more important than another" (Stidham).

MORE DISTURBING FACTS

The WM3IP, Inc. has conducted a nationwide search of all charitable organizations and could find no corporation or legal entity whose task it is to supervise and account for any of the reported millions of dollars raised by the West Memphis Three Legal Defense Fund and spent by Lorri Davis primarily on behalf of her husband, Damien Echols.

The imbalance in funding between the three men’s teams illustrates why Echols' case has progressed almost to the federal level, while neither Baldwin nor Misskelley has yet had a single post-conviction hearing. 

We encourage donors to ask the following questions before they commit money to any fund.

  1. How much money has been raised in the name of the West Memphis Three?
  2. How much of that money is being devoted to the defense of all three of them?
  3. Why is Dan Stidham, the only attorney from the original defense teams, a man who has given fifteen years of his life pro-bono to this cause, concerned that his former client does not have the resources to litigate all aspects of his case at this point ?
  4. Can it be true that the websites devoted to this case and in existence thus far do not provide a means to verify how donated monies are spent, and to whom they are directed?
  5. Isn't it a clear conflict of interest for a spouse of one of the WM3 to have what appears to be ultimate control over funding that is intended for all three young men?

OUR GOALS

Inspired by the dedication of attorney Dan Stidham, someone who has devoted one-third of his life, and three-fourths of his professional career to standing by his client and the cause of all three young men, the WM3IP was created to bring honesty, openness and integrity back into the fundraising efforts for the West Memphis Three. We find the current situation - no accountability to donors, arbitrary spending, and unclear legal agendas - to be troubling and unfair.

Our goal is to offer a legitimate alternative that will benefit all of the WM3 defendants.

  1. We will always conduct our activities in the open, with full disclosure, keeping the individual names of our donors confidential (unless otherwise requested by the donor).
  2. The WM3IP, Inc. will answer any and all questions related to your donations.

Your fully tax-deductible donations will be collected and distributed according to the laws and restrictions of a duly-legitimized 501(c) (3), not-for-profit corporation, with complete, public accountability for any and all funds we receive. This is by state and federal law since we are a 501(c)(3) (filed/pending).
